PROCEDURE TO APPLY FOR ROAD CLOSURE – 2024

Requirements of the Rationalisation of Local Government Affairs Act before any such action can be taken.

As per Chapter 7 of the Rationalisation of Local Government Affairs Act.

  1. Any person, body or organisation may apply to a municipal council for authorisation to restrict access to a public place by –

 (a)       submitting a written application specifying –

  • the name and contact details of the applicant.
  • a description of the public place which is the subject of the application;
  • a description of the circumstances giving rise to the application;
  • the category and estimated number of persons affected by the circumstances giving rise to the application;
  • the nature and extent of the restriction in respect of which the application is sought; and
  • the category and an estimate number of persons who may be affected by the restriction in respect of which the application is sought;

 (b)       furnishing proof that at least two thirds of the persons affected by the circumstances giving rise to the application approve of the restriction in respect of which the application is sought; and

 

  1. After receiving the application, the municipal council will arrange for a meeting to be convened with the applicant and the South African Police Service for purpose of enabling it to determine –
  • the merits of the application

Important! Ensure there is documentation of:

  • A diagram of the area that is going to be affected.
  • A diagram of the type of restriction that is going to be used.
  • Traffic impact study by a qualified traffic engineer not Traffic Department or Traffic officials but Engineers.
  • Also ensure when compiling the application you have a table of content.

 

  1. The process internally by the council after scrutiny of application is to get:
  • Comments from Each Department in the council

 

  1. An amount payable for approval as per Municipal tarrifs.

 

  1. Municipality will stipulate the years of agreement and renewal thereof.

 

  1. Signed Agreement with conditions on the road closure will be given to the residents and a copy will be kept at the office.
