The Executive Mayor Bongani Baloyi on behalf of Midvaal Local Municipality, welcomes judgment delivered on Wednesday 21st August 2019 in the Equality Court to outlaw the old apartheid flag from public display. This is a profound victory for all South Africans.
This follows after Nelson Mandela Foundation took the case to court because of a public debate between the foundation and Afriforum, after reports that the old flag was displayed at a Black Monday demonstration in October 2017.
Judge Mojapelo has ruled that display of the apartheid flag demonstrates a clear intention to be hurtful, harmful and incites harm, promotes and incites hatred against black people in terms of the Equality Act.
“To end hatred and old practices of apartheid, we must always name issues for what they are”, the mayor said.
Furthermore, the mayor wishes to reiterate a call on all South Africans to invest in a social cohesion agenda. where people are protected against life risks, trust their neighbours and the institutions of the state and can work towards a better future for themselves and their families.
The findings of the court are indeed consistent with social cohesion agenda.
